Terms and conditions of use

  1. Contract
    These general purchase conditions apply to the sale of all products of Bene emo through its website Beneemo.se, to consumers to whom orders can be delivered in all countries belonging to the European Union (see point 5). Bene emo informs that our Website is intended only to 18-year-old audience. Bene emo reserves the right to cancel the account of a user if the use of this service is fraudulent.

  2. Price
    The applicable prices are those indicated on the website of Bene emo at the date of the order. Prices are detailed in each product and VAT (value added tax) is included. Prices are not including shipping costs, these are stated separately when you place the order.
    Bene emo reserves the right, at any time and without prior notice, to make the modifications it deems appropriate, and may update, even daily, products and prices according to the innovations that will appear.

  3. Payment
    Payment will take place upon completion of the purchase process and will be an indispensable condition for the formalization of the purchase. Purchases can only be paid trough the payment service of PayPal. Providers or issuers of payment can adopt anti-fraud measures involving the rejection of certain types of operations. Bene emo is not responsible for the implementation of this type of security policies.

  4. Delivery
    Bene emo makes every effort to ensure the delivery of your order within 2-5 working days in Sweden and 10 working days (for the rest of the countries) from when your purchase is registrated on the website.
    Your parcel will be shipped by PostNord or any of their partners. Delivery is carried out to the address of your choice. Please note that we only ship to your home or office addresses and not to P.O. Box addresses.

    In the email confirmation of your order, you will find the number of shipping package. This number will allow you to track your parcel in real time. To do this, simply log in to the website of PostNord: www.postnord.se

    In the case of absence at the time of delivery, a slip will be left in the customer's mailbox explaining that the package will be held for 15 consecutive days at the nearest Post Office. After 15 days, the package will be sent back to Bene emo, which will contact the Customer to propose a solution to the problem.

  5. Shipping costs
    Shipping cost inside Sweden is 58 swedish crowns.
    Shipping cost outside Sweden is 85 swedish crowns (see list below which countries we are shipping to):

  6. Returns
    Bene emo offers you the opportunity to return all or part of your order within 14 calendar days of receipt of your package.

    To do this, simply follow a few rules:

    • - The package must be returned to the following address:

    • - The returned package should be accompanied by the return note. In case of partial return, you must indicate on the return note of the products which one you do not want to keep.
    • - In addition, the products must be packed carefully in their original packaging and/or in a package specifically designed for this purpose and tape well adjusted. Bene emo guarantees a full refund (Withdrawal of Order), if all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or hangtags should be intact. Bikinis and swimsuits can only be returned if the sanitary liner strip is intact. Bene emo strongly recommends trying on bikinis and swimsuits with your panties lingerie underneath and with your skin free of makeup, body lotion or self tanning lotion to avoid any dirt on the item.
    • - All shoes should be tried on a carpeted surface before wear. Shoes should always be returned in the same way they were delivered.
    • - The return costs are entirely your responsibility.
    • - All returned products, except exceptions below, are reimbursed. There is no possibility to exchange.
    • - Please note that bags, handbags, sun creams & after sun creams are not possible to return or exchange.
    • - Shipment is your responsibility, Bene emo strongly recommends you to use the service "Registered package" or any other service provider offering you similar guarantees in the event of loss, theft or deterioration of the parcel.
    • - Remember it is you, the customer, who is responsible for the return until we have received and registered it, so always save your deposit slip as proof of your postage and please inform us about the return and the tracking number of your return. It can sometimes take up to 14 days for a return to come to us and be processed at our store. Please be aware that all items sent back to us must be in original condition and include all labels and hangtags.
    • - In case of non-compliance with the aforementioned conditions and deadlines, Bene emo reserves the right to not refund and refuse the package which will then be shipped back to the Customer.
    • - If you are not sure if we will accept your return, please contact us before via e-mail: order@beneemo.se

    You will receive a return confirmation via email as soon as we have received your return. It might then take up to 21 days until your refund will be processed. Refund will be made to you in the same way as the payment. Shipping costs are non-refundable.

    NOTE: If you receive a faulty or incorrect item, please contact us and await further instruction before returning the item(s).

  7. Exclusion of Liability
    We will not be responsible for any failure or delay in the performance of any of obligations, when the same is due to events which are beyond our reasonable control ("force majeure cause"). The causes of force majeure shall include any act, event, lack of exercise, omission or accident which is beyond our reasonable control, among others, the following:

    1. Strikes, lock-outs or other industrial action.
    2. Riot, civil commotion, invasion, threat or terrorist attack, war (declared or not) or threat or preparation for war.
    3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
    4. Loss of use of trains, boats, aircraft, motor transport or other means of transportation, public or private.
    5. Inability to use public or private telecommunications systems.
    6. Acts, decrees, legislation, regulations or restrictions of any Government or public authority.

      Means that the obligations will be suspended during the period in which the cause of force majeure continue, and we will have an extension on the deadline to fulfil these obligations for a period of time equal to that last the cause of force majeure.

  8. Limitation of Liability
    Bene emo (EF) is exempt from any liability for:

    1. Failure in the Web due to causes of force majeure, fortuity causes, or other causes not attributable to it.
    2. Technical or mechanical problems or viruses produced during the connection to the Internet, computer systems (software and hardware) or in the documents and electronic files stored on computers.

    3. Minors access to the content included in the website, being the responsibility of parents / guardians exert an adequate control over the activity of children or minors in their charge.
      Due to the open nature of this website and the possibility that errors occur in the storage and transmission of digital information, we do not warrant the accuracy and security of the information transmitted or obtained through this web site unless expressly otherwise provided therein.

  10. Applicable Legislation and Jurisdiction
    The use of our website and contracts for the purchase of products through this website shall be governed by the Swedish law.
    Any disputes shall primarily be settled by agreement after discussion with Bene emo customer service.
    If a dispute cannot be resolved through discussion with Bene emo customer service, you, as the customer, can directly submit complaints online via the EU-commissions platform mediation for disputes, which can be found at the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via that platform, your submission will automatically be forwarded to the correct national body responsible for resolving disputes. That body will then contact us and try to resolve the dispute without court involvement. In any dispute, Bene emo follows the decision of ARN or the respective Dispute Settlement Body.
    Disputes concerning the interpretation or application of these General Terms shall be settled as determined under paragraph above, or ultimately shall be subject to the jurisdiction of the Swedish courts.

  11. Intellectual property and copyright
    The information contained in this website, its design, photos etc... is a work which copyright belongs to Bene emo. Internet users accessing this website can visualize the information contained therein and make downloads or reproductions in their computer system, provided that the reproduced elements are not subsequently transferred to third parties or be installed on a server connected to Internet or to a local computer network.

    The distribution, modification, cession, public communication and any other act that has not been expressly authorized by the owner of the exploitation rights are prohibited. Violation of any of these rights may constitute an offence punishable in accordance with the existing criminal code. Bene emo and their logos are registered trademarks. Any use of them is strictly prohibited without the express permission of the owner.

  12. Changes to the Terms and Conditions of use
    Bene emo recommends that the customer regularly remains updated on the website in order to become aware of any changes to the Terms and conditions of use.

Bene emo is a legal trading name and the company was registered in Bolagsverket, Sweden, in December 2016. Bene emo is approved for corporate tax and is paying tax in Sweden.
